In an unpublished opinion, the Appellate Division affirmed the dismissal of a Complaint against a bus company for its alleged failure to intervene in a case involving an assault on a bus. In affirming the dismissal, the Appellate Division specifically emphasized that the opinions of the expert failed to establish a causal connection between the actions or inactions of the driver and the happening of the incident. The Appellate Division further ruled that the expert for plaintiff was not qualified to offer opinions as his opinions lacked any foundation.
